Illness and Injury


It is apparent that the Club Rule covers all types of personnel claim. It is laid out in the following way;

  • The cover is defined as extending to claims under the operation of law and contract.
  • The types of risk covered are described in detail in nine different categories.
  • The types of personnel to whom the cover applies are described in five different categories. The range of risks covered for each category of personnel is different, and these are listed for each category of personnel.

In the text that follows, general guidelines for claims handling are given for illness and injury claims which apply in most cases. Then additional notes are set out for each category of personnel as follows;

Crew
Supernumeraries
Passengers
Third Parties
Deserters and Stowaways 


Guidelines for Procedures following Illness or Injury

As with any other type of claim it is important that the Club is informed early and is involved and kept advised of progress in the handling of a claim. Early response, treatment and compassionate care for an injured or ill person are not only the correct human response but can be very important in the successful resolution of claims.


Illness

if a person is taken ill, initial diagnosis is clearly important. Shore side assistance should be requested if there is any doubt. The Clubs correspondent should be involved if the vessel is in port;

Injury

Injury claims often involve complex issues of national and international law and the potential for very large claims. It is therefore important that Members report claims, or serious incidents that they consider might give rise to a claim, in order that the Club may consider the steps to be taken to assist the injured and protect the Members position as soon as possible.
