This category of personnel includes, for example, stevedores injured during cargo handling operations, crew on other vessels injured in a collision with the entered vessel, bystanders injured by fire or explosion on the vessel or any other person alleging that they have suffered injury, illness, medical or funeral expenses because of actionable conduct on board the entered vessel.

The general guidelines set out at the beginning of this section for the handling of illness and injury claims apply equally to claims in relation to this category of personnel although in some cases claims may arise without the member being aware of the circumstances at the time. In such cases careful investigation of the facts after the event will be necessary. This emphasises the need for careful record keeping at all times during vessel operation. While it is always difficult to prove a negative, evidence from an efficient record keeping system that no incident occurred or was notified can be as important as the gathering of evidence after an incident has actually occurred.
